In December 2022, the Township was subpoenaed by the Attorney General to produce pay records, time sheets and attendance records for all Township Council members. These records were required to be delivered by January 13, 2023.
Rather than perfunctorily comply, the Council engaged Riker Danzig as counsel to attend to the subpoena. Between January and November of 2023, Riker Danzig invoiced the town for 274 hours of time to respond to the subpoena at a cost of $56,000 to Montclair taxpayers.
On top of that, Montclair taxpayers are compelled to reimburse the councilors for legal fees incurred to defend them, which has already cost the taxpayers over $8,000.
The Indemnification Ordinance was passed by the same councilors who fraudulently claimed to be eligible for state health benefit plan coverage on April 12, 2023, months after the subpoena was served. See Censorship.
